In using our website systems, the following terms and conditions apply:

  1. It will the decision of ProfessionalHosting as to whether we have completed your website within the limits set by the specification. Any changes after completion will be chargeable at our usual hourly rate.
  2. A contact page with a contact form is still a “form”. a “Form” is any form you fill in. Not just paperwork forms, but web forms as well. Anything where you have to fill in details like your name, email address, phone number, and press a “submit” button to send it, is a FORM. All forms are chargeable. See our Pricing Page for more.
  3. We require a deposit of 50% up-front before we will proceed with designing your site.
  4. All customers will be charged for bandwidth usage in excess of 500MB and/or disk usage in excess of 10 GB. BusinessHosting customers will be charged for disk usage in excess of 100 GB.
  5. When you hire us to build your website, we have a contract that you are required to sign which agrees to certain procedures so that we can fulfil your requirements as efficiently as possible. Each contract is tailored for each client and lists the project specification that has been agreed to. We cannot proceed until the contract is signed and the scope and limitations of the project are defined.
  6. If you are hosting with us, we require the domain registration fee to be paid before we will proceed with designing your site or hosting it.
  7. When we believe that we have completed your site, we will notify you of such an occurrence. If there are errors on your site, we will make corrections to those errors. However, any further changes beyond error corrections, including additional pages, further text content, further image content, further multimedia content, layout changes, any colour changes, any domain name changes, will all be chargeable at our usual hourly rate.
  8. If you make an error in the spelling of your domain name, and we have already registered your domain name with the spelling error, you will be liable to pay for re-registration of the domain name with the spelling error corrected, at our usual price.
  9. If we grant you a free website, you will be liable for the annual domain renewal fee and you will be required to place and keep any adverts on your site that we provide, with a minimum requirement of a link to our home page in the footer of your page, and a square advert on the left or right hand side of each of your pages. You accept that we will not provide any technical support of any description if we have given you a free site. We reserve the right to cancel and close a free site immediately without warning if it violates any of our terms and conditions or if you do not pay the annual domain renewal fee.
  10. If we provide you with a free template site, that site will contain no more than three (3) pages of our design, and those pages will be used for: contact details, a paragraph about your company, and a page listing your products or services (one each of these three items per page). By “template site” we mean that the template will be a template that we provide and design. We will not create a site for you from a template that you provide (of any description).
  11. If your account is in arrears, we reserve the right to suspend your web hosting service and/or delete your site and close your account. We reserve the right to decline to backup your data before erasing it, or give you a copy of it. If you wish to transfer to another hosting provider and your account is in arrears, we reserve the right to not hand over your site data until your account is settled and paid in full.
  12. You may not grant anyone other than yourself access to data on your website which is not directly relevant to the purpose of your website or your business, as this may constitute software or media piracy. You may only do so if the person who you are granting access to, has a legal right to access that data, eg. your employer requiring access to documents that you created for that employer or whilst on that employer’s business premises.
  13. You may not use our websites to store, disseminate, or otherwise publish or make public any data of the following kinds:
    • Data, videos or images that are Pornographic
    • Data or images that are in poor taste
    • Data, documents or images that are Racist, Sexist, or discriminatory on any grounds pertaining to religion or sexual orientation
    • Private data belonging to any person including yourself, which data may include but not be limited to Identity Document information, ID numbers, Social Security Numbers, signatures, and credit card or other banking details, unless the purpose of that website is explicitly designed to securely contain and protect such data, and was explicitly created for that purpose, and is only accessible via a password and the HTTPS protocol.
    • Application Programs, EXE files, unless they have been scanned by a virus checker and you yourself wrote those application programs AND you are legally entitled to publicise or make those programs available for download AND those application programs are no larger than 20 MB (Megabytes) in size AND you obtain our permission first AND those application programs are directly related to the nature of your business.
    • Malware, Trojans, Viruses, Worms
    • Data or documents that are intended to deceive, mislead, defraud or otherwise cause financial inconvenience to anyone in any way
    • Data or documents that are intended to sexually harass or otherwise harass anyone in any way
    • Files larger than 20 Megabytes in size, unless you have received explicit permission from us in writing.
    • Files containing pirated material, including but not limited to: mp3s, avis, mp4s, m4ps, movs, asfs, etc.
    • Any media files that do not directly pertain to your business or personal life, which said files were not created by you or someone you personally know. If you wish to place a home video or similar media on your website, please rather place it on YouTube and ask us to provide you with code to embed the YouTube video feed into your website.
    • Private material including but not limited to passwords, user login names, credit card numbers, ID numbers, social security numbers, or any other financial or access-related private information.
  14. If we create your website and subsequently hand it over to you for direct modification by yourself, the following terms and conditions apply:
    • We will not grant you access to, or modifcation rights on, any CGI-script that we have created or provided. If you create a CGI yourself for use on your site, you are required to allow us to review the code for security purposes and you are required to notify us that you have created such a thing. If you require a modification to the way an existing CGI works, you have to request those changes from us and we will charge you at our standard rates.
    • If you create a PHP script yourself for use on your site, you are required to allow us to review the code for security purposes and you are required to notify us that you have created such a thing. If you require a modification to the way an existing PHP script works, you have to request those changes from us and we will charge you at our standard rates. In particular, use of shell_exec is prohibited.
    • If you wish to re-use any code that we have created, and deploy the said code elsewhere, you have to obtain our permission, as we retain copyright on all our code, whether it is explicitly stated as such in the code or not.
    • If you make a change to your site which causes the site to become dysfunctional or malfunctional in any way, we will not be held responsible for that. If you require that we repair the site after you have modified it in such a way, we will charge you at our standard rates to repair the site. If we regard the site as beyond repair, we reserve the right to revert it to the last working backup version of it, which may undo all changes you have made since we handed it over. If you have a free site, it is completely up to you to repair any damage to it.
    • If we discover that you have placed or allowed to be placed any malicious code on your site for any reason or purpose whatsoever your site will be suspended and a case will be opened with the authorities.
  15. We do not generally provide or allow bulletin board or chat sites. If you require such a thing, you accept full responsibility for maintaining the integrity and security of the site. If your bulletin board or chat site starts to receive spam, we will not assist in preventing this, as this is beyond our control. You should protect your bulletin boards with a Captcha system. If your bulletin board is hacked and as a result the hacker is able to compromise the server security, the bulletin board will be removed without warning.
  16. We do not generally provide PHPMyAdmin as it is a security risk. If you require it, we will place it at an obscure URL that is hard to access. If PHPMyAdmin is hacked and as a result the hacker is able to compromise the server security, PHPMyAdmin will be removed without warning.
  17. You agree to be bound to the general terms and conditions.
